Ibiza rental income can influence price, but the legal right to market tourist stays must be proved separately from ownership and separately from historic revenue. Current rules, property type, zoning, registration and compliance all matter.
Key points for the buyer
- Verify the full licence or declaration file with the authority.
- Match authorised places and spaces to the actual lawful property.
- Confirm the legal route after a change of owner or operator.
- Do not treat platform history as evidence of permission.
What evidence to request
Obtain the tourism registration or declaration, authorised modality and capacity, operator details, plans and compliance records. Verify them with the competent authority and compare the property identity with registry and cadastral data.
Ask about inspections, sanctions, complaints and any conditions. A number in an advert is not sufficient due diligence.
Zoning, containment and property eligibility
Ibiza’s island framework operates within Balearic tourism law and current containment measures. Eligibility can depend on zone and property type, and new places may be restricted. The position should be checked at the time of purchase.
A seller’s ability to operate does not necessarily mean a buyer can obtain a new authorisation if the existing basis is surrendered or defective.

Planning legality still matters
Tourism status does not validate unauthorised rooms, pools or extensions. Compare authorised guest areas and capacity with the legal planning configuration and occupancy documents. A mismatch can create both planning and tourism exposure.
For villas, coordinate an architect’s survey and lawyer’s authority checks.
Transfer, operator and contract
Determine the procedural effect of the sale, any owner or operator change, required notification and the seller’s continuing cooperation. Make verified continuity a contractual condition if it supports the purchase price.
Address bookings, guest deposits, management agreements, staff, websites, platform accounts, furniture and data. Not every business asset is transferable.
Assess the investment conservatively
Legal permission is one part of the investment case. Review genuine revenue, costs, tax, seasonality and management separately. Model the purchase without tourist income if the legal continuation is uncertain.
Use warranties and remedies proportionate to the claimed licence value; do not rely on promotional statements alone.
